We just changed insurance companies in my job. The Benefits Manager explained how the pre-existing condition policy works with all the new laws that were enacted. He told us that if we’re in the same job for a period of time (60 or 90 days I believe) it’s not considered a pre-existing condition. If you happen to switch jobs you need to get a letter from your old employer stating that you have been insured all this time. Apparently that is how you get around the pre-existing clauses. If you go into a job and were previously unemployed and without insurance I believe the pre-existing clauses do get enforced.
If you’d like I can go back through the literature we got at the time and see what it says. I believe I can find it- I am so disorganized when it comes to paper and never have time to file anything!

Each state has different laws, but if your present insurance has been paying and you don’t have longer than a 60 day break in service, my understanding is that they will pay. I know it is existing, but your other option is to COBRA your present insurance until you are covered.

Thanks for clearing this up for me. It looks like I’ll be ok since I’ve been covered for three years. Suppose I have been covered by my husbands employer and I go out on my own? Same thing?
